From a lawsuit filed last December in Galveston, Texas, against Sergeant Gilbert Gomez and Officers Justin Popovich, Sean Stewart, and David Roark, on behalf of plaintiffs Emily Milburn and her daughter, Dymond. On September 15, 2006, police arrived at Dymond’s middle school and arrested her for assaulting a public servant, a charge that stems from Dymond’s struggling during the incident described below.
On the night of August 22, a blue van drove up while Dymond Milburn, an African American, was in the front yard of her home. At the time, Dymond was twelve years old and an honor student taking advanced classes at her middle school. She was five feet six inches tall and weighed 120 pounds and was wearing a T-shirt and red athletic shorts.
